1. Acceptance of Terms

By accessing or using TheProfession.org, a platform operated by OpNex (OPC) Pvt Ltd, you confirm that you have read, understood, and agreed to be bound by these Terms of Service. These terms form a legally binding agreement between you and OpNex (OPC) Pvt Ltd. If you do not agree with any part of these terms, you must stop using the platform immediately. These terms apply to all users including job seekers, employers, recruiters, institutional partners, training programme participants, and general visitors.

2. Eligibility

You must be at least 16 years of age to create an account on TheProfession.org. By registering, you confirm that you are legally capable of entering into a binding contract under Indian law. If you are registering on behalf of a company or institution, you confirm that you have the authority to bind that organisation to these terms. Users who provide false information about their age or identity will have their accounts terminated immediately.

3. User Accounts and Registration

You are required to provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials including your password. You must notify us immediately at support@theprofession.org if you suspect any unauthorised access to your account. We are not liable for any loss or damage arising from your failure to protect your account credentials. You may not create multiple accounts for the same individual. Accounts may not be transferred, sold, or shared with any other person or entity.

4. Job Seeker Responsibilities

Job seekers agree to provide truthful and accurate information on their profiles, resumes, and all communications with employers through the platform. Misrepresenting your qualifications, work experience, educational background, certifications, or identity is strictly prohibited and will result in immediate account termination. You grant OpNex (OPC) Pvt Ltd a non-exclusive, royalty-free licence to display your profile, resume, and application data to registered employers and recruiters on the platform for the purpose of facilitating job matching. You retain full ownership of your own resume and profile content. You may delete your data at any time as described in our Privacy Policy.

5. Employer and Recruiter Responsibilities

Employers and recruiters who register on TheProfession.org agree to post only genuine, accurate, and currently open job positions. Posting fake listings, misleading job descriptions, roles with undisclosed payment structures, or positions that do not exist is strictly prohibited. Employers must not use the platform to collect personal data from candidates for any purpose other than evaluating their application for the specific role posted. Job postings must comply with all applicable Indian labour laws and must not discriminate on the basis of caste, religion, gender, sexual orientation, age, disability, national origin, or marital status. Employers are independently responsible for verifying the accuracy of candidate-submitted information and for their own hiring decisions. TheProfession.org is not liable for any hiring outcome.

6. College and Institution Partners

Educational institutions that register as college partners agree to submit accurate student batch data and to use the placement management tools solely for the purpose of facilitating legitimate internship and job placements for their enrolled students. Institutions must obtain appropriate consent from their students before submitting student data to the platform. The institution's Training and Placement Officer is responsible for ensuring that all data submitted through the college partner portal is accurate and authorised.

7. Prohibited Conduct

The following activities are strictly prohibited on TheProfession.org. You may not scrape, crawl, or systematically harvest data from any part of the platform through automated means. You may not use the platform to send unsolicited messages, spam, or phishing communications to other users. You may not post content that is false, defamatory, obscene, hateful, or in violation of any applicable law. You may not attempt to gain unauthorised access to any part of the platform, its servers, databases, or user accounts. You may not use the platform for any illegal purpose or to facilitate illegal activity. You may not impersonate any other person, company, or entity. You may not reverse engineer, decompile, or attempt to extract the source code of the platform. Violation of any of these prohibitions may result in immediate account termination and legal action.

8. Content Standards

All content posted on TheProfession.org including job listings, profile information, messages, and any other user-generated content must be accurate, lawful, and respectful. Content that promotes violence, discrimination, illegal activity, or that infringes on the intellectual property or privacy of any third party is not permitted. We reserve the right to remove any content that violates these standards without prior notice. Repeated violations will result in permanent account suspension.

9. Platform Availability and Modifications

We make reasonable efforts to keep TheProfession.org available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted access to the platform. We may perform scheduled or emergency maintenance at any time. We reserve the right to modify, suspend, or discontinue any feature or the entire platform at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

10. Payments and Subscriptions

Paid subscription plans on TheProfession.org are billed in advance on a monthly or annual cycle as selected at the time of purchase. All payments are processed securely through Razorpay, a licensed payment aggregator. By subscribing to a paid plan, you authorise us to charge the applicable fee to your selected payment method on each billing cycle. We offer a 7-day money-back guarantee for first-time subscribers who are not satisfied with their paid plan. Refund requests must be submitted within 7 days of the initial payment by emailing support@theprofession.org. Refunds are not available after the 7-day period except in cases of technical errors on our part. Subscriptions auto-renew unless cancelled before the renewal date. You may cancel your subscription at any time from your account settings. We reserve the right to change pricing for subscription plans with 30 days advance notice to existing subscribers.

11. Intellectual Property

All content, design, code, branding, logos, and features on TheProfession.org are the intellectual property of OpNex (OPC) Pvt Ltd unless otherwise stated. This includes but is not limited to the TheProfession.org name, logo, AI resume scoring algorithms, job matching engine, interface design, and all written content produced by our team. You may not reproduce, copy, distribute, modify, or publicly display any part of the platform without prior written permission from OpNex (OPC) Pvt Ltd. Users retain ownership of content they personally create and upload such as their resume and profile text. By uploading content to the platform, you grant us a limited licence to store and display that content as necessary to provide the service.

12. Third-Party Links and Services

TheProfession.org may contain links to employer career pages, external job listing sources, training resources, and other third-party websites. These links are provided for convenience only. We do not endorse, control, or take responsibility for the content, privacy practices, or availability of any third-party website. Accessing any third-party website through links on our platform is entirely at your own risk.

13. Disclaimer of Warranties

TheProfession.org is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not guarantee that the platform will be error-free, uninterrupted, or free of viruses. We do not guarantee the accuracy or completeness of any job listing, employer information, candidate profile, or AI-generated output on the platform. We make no representations about the outcome of any job application, interview, or hiring process facilitated through the platform.

14. Limitation of Liability

To the fullest extent permitted by applicable Indian law, OpNex (OPC) Pvt Ltd and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of TheProfession.org. This includes but is not limited to loss of employment opportunity, loss of income, loss of data, or reputational harm. In all cases, our total liability to you for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless OpNex (OPC) Pvt Ltd and its directors, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses including reasonable legal fees arising from your use of the platform, your violation of these Terms of Service, or your infringement of any third-party rights.

16. Termination

We reserve the right to suspend or permanently terminate your account at any time and without prior notice if we determine that you have violated these Terms of Service or any applicable law. You may also delete your own account at any time from your account settings. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination will continue to apply.

17. Privacy

Your use of TheProfession.org is also governed by our Privacy Policy. The Privacy Policy explains in detail how we collect, use, store, and protect your personal data. You can read the full Privacy Policy at theprofession.org/privacy. By agreeing to these Terms of Service, you confirm that you have read and understood our Privacy Policy.

18. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of India. Any dispute arising out of or related to these Terms or your use of the platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts in Meerut, Uttar Pradesh, India. For consumer disputes, you may also approach the relevant consumer forum under the Consumer Protection Act 2019 of India.

19. Changes to These Terms

We may update these Terms of Service from time to time. We will notify registered users of material changes by email and by displaying a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of the platform after changes take effect constitutes your acceptance of the revised terms. If you do not agree to the revised terms, you must stop using the platform and may delete your account.
